Iron Mountain Shares Expert Insight on Changing Electronic Discovery Rules and eRecords Management Implications

October 3, 2006

BOSTON, Oct. 3 /PRNewswire-FirstCall/ -- Iron Mountain Incorporated (NYSE: IRM), the global leader in information protection and storage services, today announced the availability of a new white paper that analyzes the impact of the impending amendments to Rule 26 and other changes to the Federal Rules of Civil Procedure (FRCP) on businesses records management programs. The white paper is available on the Company's Website at: http://www.ironmountain.com/rule26wp/.

In addition, Iron Mountain and Compliance Week will host a Webinar on October 5th at 2pm EDT, "Preparing Your Company for Litigation." The hour-long session will focus on how a legally credible compliant records management program can better prepare organizations to deal with the changing legal discovery requirements. Iron Mountain's Senior Vice President of Consulting Services, Brian Murphy, will present alongside Tim Carroll, Co-Chair of Records Management & E-Discovery Solutions, Vedder Price. To register for the Webinar, visit: http://www.ironmountain.com/litigation/.

These available resources assess the implications of FRCP Rule 26 and related amendments to the FRCP, which are aimed specifically at helping courts and litigants navigate the complexities of discovery related to electronically stored information (ESI), including the challenges businesses will face as their records management programs are severely tested. The changes to the Federal rules are scheduled to take effect on December 1, 2006, but some states are adopting them sooner. New Jersey, for example, voted on July 27, 2006, that it would adopt the new FRCP amendments in their entirety, effective September 1, 2006. Other states, including Texas and California, have either adopted some of the new rules already, and/or have some of their own rules already in place.

"Rule 26 makes the efficient management of corporate electronic records (eRecords) more vitally important than ever before," said Iron Mountain's Murphy. "Companies must be prepared to produce relevant e-mails and attachments, instant messages, transaction logs, video files, and other eRecords quickly and efficiently, or face significant fines, executive liability, and loss of business credibility."

Companies that implement records management best practices will be vastly better prepared to meet the challenges of Rule 26. However, given the staggering volume of data involved, even the most sophisticated organization can become overwhelmed to identify all relevant sources of ESI, much less search, organize, and deliver the information when faced with litigation. Iron Mountain solutions and services can help organizations to shift from a reactive response to a stance of proactive readiness.
