These available resources assess the implications of FRCP Rule 26 and
related amendments to the FRCP, which are aimed specifically at helping courts
and litigants navigate the complexities of discovery related to electronically
stored information (ESI), including the challenges businesses will face as
their records management programs are severely tested. The changes to the
Federal rules are scheduled to take effect on December 1, 2006, but some
states are adopting them sooner. New Jersey, for example, voted on July 27,
2006, that it would adopt the new FRCP amendments in their entirety, effective
September 1, 2006. Other states, including Texas and California, have either
adopted some of the new rules already, and/or have some of their own rules
already in place.
